## UK GDPR, the 2025 data act and the rules your AI software must meet

The UK has no single AI Act, so AI software is governed by data protection law and sector regulators. Your DPO or legal adviser makes the final call.

### UK GDPR and the Data (Use and Access) Act 2025

UK GDPR and the Data Protection Act 2018 apply to any AI that touches personal data. The [Data (Use and Access) Act 2025](https://www.legislation.gov.uk/ukpga/2025/18) amended both, with most changes in force from 5 February 2026, including new Articles 22A to 22D on automated decisions and a complaints duty from 19 June 2026.

### ICO guidance and your DPIA

## How to choose an AI software development company in the UK

Ask these of every supplier, including us. Vague answers here usually become expensive problems later.

1. 1 Where is each engineer based, and who is the legal entity? It decides whether you need an IDTA or UK Addendum, affects UK R&D tax relief on the work, and shows whether the team overlaps your hours.
2. 2 Will the system run in our UK cloud account? Your own AWS, Azure or Google Cloud account in a UK region keeps data under your control. Vendor hosting is fine for a pilot but needs an exit route.
3. 3 Who owns the code, prompts and evaluation data? The answer should be you, in the contract, with assignment on payment. Watch for platform fees or proprietary frameworks that make it costly to leave.
4. 4 What will you give us for our DPIA? Expect data flow diagrams, every subprocessor including model providers, hosting regions, retention periods and human review controls.
5. 5 How will you measure whether the AI works? Ask for an evaluation set built from your real examples and a pass mark agreed before the build. Trying a few prompts is not testing.
6. 6 What will it cost to run each month? Get separate figures for hosting, model usage and support, and a cost per request estimate before launch.
